General Terms and Conditions (GTC) for orders placed on www.furnituredeal.at
These General Terms and Conditions (hereinafter referred to as "GTC") govern all contracts concluded on the basis of offers made on www.furnituredeal.at (in the following also referred to as “FurnitureDeal”).
You can view and print the current GTC at www.furnituredeal.at under "GTC".
Please note that the items offered on FurnitureDeal domains are not manufactured by us; we merely act as a retailer. Unless otherwise stated in the product description, the items offered at FurnitureDeal are intended for private use. We only offer trade fair goods or photo samples, not regular new goods, on www.furnituredeal.at. The products can only be ordered and purchased as shown on the website.

1. Scope of application; contractual partners; definitions; deadlines
1.1. Contract fulfilment and delivery are carried out exclusively in accordance with these GTC, which form the basis of all offers on FurnitureDeal.at (hereinafter also referred to as "FurnitureDeal"). Any general terms and conditions that conflict with or deviate from the following provisions shall not apply.
1.2. Where these GTC refer to "consumers", these are natural persons who enter into a legal transaction for purposes that are not related to the operation of their business. "Entrepreneurs", on the other hand, are natural or legal persons or partnerships with legal capacity for whom the transaction is part of their business. The distinction between consumers and entrepreneurs is made in accordance with the Austrian Consumer Protection Act (KSchG). "Customers" within the meaning of these GTC are both consumers and entrepreneurs.
1.3. Orders for FurnitureDeal items may only be placed by persons who have reached the age of 18. Persons who have not yet reached the age of 18 require the consent of their legal representative.
1.4. Where business days are specified as deadlines in these GTC, this refers to all weekdays with the exception of Saturdays, Sundays and national public holidays.
2. Registration on www.furnituredeal.at
2.1 You can create a customer account on FurnitureDeal. When creating a customer account on FurnitureDeal, you will be asked to register and provide your personal details. Confirmation of registration will be sent immediately after the registration form has been submitted. Only one customer account may be opened per customer.
2.2 When entering your personal details for registration, you are responsible for providing truthful and complete information. You are obliged to treat your personal access data confidentially and not to make it accessible to third parties.
2.3 You are solely responsible for content (such as reviews) that you post in areas accessible for this purpose. This content must not infringe the rights of third parties. FurnitureDeal provides areas for your content on a purely voluntary basis and expressly reserves the right to close or change these areas. There is no entitlement to the storage or publication of your posted content.
2.4 Customers are entitled to use the online offer within the scope of its availability. The content may only be used for your own private, non-commercial purposes. You must refrain from any disruption of the FurnitureDeal domain or further use of the accessible data outside the scope of the intended use within the platform.
2.5 We reserve the right to delete multiple registrations, to warn customers who violate the provisions set out in sections 2.1 to 2.4, to delete or modify content posted by customers, or to delete the corresponding customer account.
2.6 There is no entitlement to permanent availability of the website or access to the data or other services offered. FurnitureDeal does not guarantee that the platform or parts of the services will be available at all times. FurnitureDeal is under no obligation to accept registrations or orders from registered customers.
2.7 You must inform us immediately of any changes to your name, address or contact details. In the event of a name change, proof of identity must be enclosed with the notification of change.
3. Contractual partner, FurnitureDeal
3.1 At FurnitureDeal, we offer goods for sale in online shops. When your placed order is accepted, the sole proprietorship "Hannes Aschauer, Ossiacherstrasse 62, 9523 Villach - Landskron" becomes your contractual partner.
3.2 Unless expressly stated otherwise, these GTC apply to all orders you place on FurnitureDeal.
4. Order process; correction options; storage option; contract text
4.1 The items offered on FurnitureDeal represent an invitation to you to submit a purchase offer. The order process is structured as follows: You select an item from the offers on FurnitureDeal and specify the desired quantity of the item to be ordered. You prepare the order for the selected item by saving it in the shopping basket by clicking on the "Add to basket" button. You can now return to the catalogue view by clicking on the "Continue shopping" button and select further items and add them to the shopping basket as described. To continue with the order for the selected items, click on the "Go to basket" button.
4.2 In the shopping basket, you can check and correct the number of selected items, remove individual items from the shopping basket or add further items using the "Continue shopping" button. By clicking on the "Proceed to checkout" button, you will be guided through further steps to call up your existing registration or to enter your details to create a customer account or place a guest order. You can then specify a different delivery address and choose one of the payment methods offered. You will also be asked to agree to the GTC and the applicable data protection provisions. You will also be asked to check your details and correct them if necessary before submitting your order.
You can also select the assembly option by clicking on the "Delivery including assembly" button. In this case, the assembly costs will also be displayed in your shopping basket.
By clicking on the "Buy now" button, you are submitting a legally binding offer to conclude a purchase contract for the items in your shopping basket. You are bound by this offer for seven business days (hereinafter referred to as the "acceptance period").
4.3 Further details on the conclusion of the contract can be found in section 6 of these GTC.
4.4 You can print or save the contract text before submitting your order. You can also archive your order data by either (i) downloading the General Terms and Conditions and saving the data summarised on the last page of the order process using your browser functions, or (ii) wait for the automatic order confirmation and the contract confirmation, which we will also send to the email address you provided after you have completed your order. It is not possible to retrieve the contract text separately.
5. Payment methods; due dates
5.1 In principle, you can pay by credit card for all orders. In addition, EPS instant transfer and PayPal are available as payment methods. GPay, shop
5.1.1 Depending on the choice of available payment methods, a (pre-authorised) reservation of the amount may be made when the order is completed. In this case, your credit card account will be charged shortly after such reservation.
5.1.2 If you choose PayPal as your payment method, you pay the invoice amount via the online provider PayPal (Europe) S.à r.l. & Cie, S.C.A., 5th floor, 22-24 Boulevard Royal, 2449 Luxembourg (hereinafter "PayPal"). In this case, the purchase price plus shipping costs is due for payment immediately. To pay via PayPal, you must be registered with PayPal or register for this purpose. During the ordering process, you will be redirected to the PayPal website, where you can log in with your access data and confirm the payment instruction to us.
5.2 Please note that only payments from accounts within the European Union (EU) are accepted for orders placed on FurnitureDeal. Under no circumstances will we bear the costs of a money transaction.
5.3 Invoices for orders placed on Furnituredeal will be sent to you exclusively in electronic form (currently via email).
5.4 Please note that the purchase price is due for payment immediately upon placing the order. If we do not confirm the order within the acceptance period, the purchase price will be refunded immediately using the payment method you had chosen for payment.
5.5 Any payments, in particular refunds, will only be made to the bank, PayPal or credit card account you used for payment.
6. Language; conclusion of contract
6.1 Contracts relating to items offered on FurnitureDeal can only be concluded in German.
6.2 The presentation of goods on FurnitureDeal does not constitute a legally binding offer, but merely a non-binding online catalogue. By clicking on the "Buy now" button, you are submitting a binding offer to purchase the items contained in your shopping basket.
6.3 Confirmation of the technical receipt of your order will follow immediately after we receive the order via email to the email address you provided. This confirmation of receipt of your order does not yet constitute acceptance of your order.
6.4 A binding contract for the purchase of the items included in your order is concluded when your order is accepted. Information about the acceptance or rejection of the order will be sent by email to the email address you have provided. Please note that we may also accept the items included in your order individually.
6.5 As mentioned above, you are bound to your respective order for seven business days.
7. Statutory right of revocation for consumers
7.1 Right of revocation
As a consumer, you have the right to revoke the contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of revocation, you must inform us of your decision to revoke the contract by means of a clear statement (e.g. a letter sent by post or e-mail). You can use the sample revocation form (Muster-Widerrufsformular) available on our website, but this is not mandatory.
To meet the revocation deadline, it is sufficient for you to send your notification of exercising your right of revocation before the revocation period expires.

7.2 Consequences of revocation
If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your revocation of the contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.
In the case of ordered services (e.g. assembly), the revocation period for this service expires upon conclusion of the contract.
We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods immediately and in any case no later than fourteen days from the date on which you notify us of your revocation from the contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods. The costs are estimated at approximately 10% of the respective value of the goods.
You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties and functionality. The goods must also be repackaged in their original packaging.
If you have requested that the services should commence during the revocation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal with regard to the contract, compared to the total scope of the services provided for in the contract.
7.3 Exclusion or premature expiry of the right of revocation
The right of revocation does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
7.4 General information
Please avoid damaging or contaminating the goods. Return the goods to us in their original packaging with all accessories and packaging components. Use protective outer packaging if necessary.

8 Availability; delivery times; transfer of risk; delivery area
8.1 Many of the items offered on FurnitureDeal are kept in stock by us, but there is only one of each item, as they are trade fair goods or photo samples. Therefore, orders may overlap and we may not be able to accept all orders. We will notify you of this by email within the acceptance period.
8.2 The delivery time for FurnitureDeal items is approximately 4-6 weeks. Unless expressly agreed otherwise, the delivery dates stated are non-binding. If a binding delivery date has been agreed separately, this shall be extended if there are obstacles or circumstances that prevent timely delivery, provided that these circumstances were not culpably caused by us. You will be notified immediately of the beginning and end of such obstacles or circumstances.
8.3 For consumers, the risk of accidental loss and accidental deterioration of the goods sold by Furnituredeal shall pass to the consumer upon delivery of the goods to the consumer or a recipient designated by the consumer. The handover shall be deemed to have taken place if the buyer is in default of acceptance. Otherwise, the risk of accidental loss and accidental deterioration of the goods shall pass to the buyer upon handover, or in the case of mail order purchases, upon delivery of the goods to the carrier or other person designated to carry out the shipment.
8.4 FurnitureDeal items are generally delivered exclusively within the Republic of Austria. If the customer wishes to have an item delivered outside Austria, they can send us a request by email.
8.5 FurnitureDeal items are delivered free of charge. By this, FurnitureDeal means delivery to your door (formerly free kerbside delivery). The shipment is unloaded at the roadside. The customer is responsible for protecting the goods from weather exposure, further transport, unpacking, setting up and assembly. The customer bears the risk of loss or damage to the goods. Delivery requires that the delivery address is accessible by lorry.
9 Prices; shipping costs; additional services
9.1 The prices listed in the offer at the time of ordering apply. The prices quoted are final prices, i.e. they include the applicable Austrian statutory value added tax and other price components, as well as shipping costs.
9.2 Deliveries from FurnitureDeal are generally made on working days between 7 a.m. and 6 p.m. The exact delivery date will be agreed with the customer in advance.
9.3 Assembly of the items can be booked at an additional cost and selected separately in the shopping basket.
10. Retention of title
FurnitureDeal items remain our property until full payment has been received, even after delivery.
11. Regulations on liability and compensation
The statutory liability and warranty rules apply.
12. Consumer dispute resolution and further information
We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
13. Applicable law
The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
